Transferring Your Vehicle's Ownership Made Easy!

Image result for Vehicle Ownership

One of the most important steps in selling or buying a vehicle is getting the ownership transferred in the name of the new owner. Without this, the process of selling a vehicle is not complete. If you are looking for information on transferring a vehicle, you are on the right page. Here are the documents you will need for the transfer of ownership:

Documents Required for the Transfer of Ownership

  1. Form 29: This form is to notify the authorities about the transfer of ownership between the buyer and seller. This is the RTO application form for transferring the ownership.
  2. Form 30: This is the report of the transfer taking place between the buyer and seller.
  3. Identity Proof: Identity proofs of the buyer and seller are required. The documents could include Aadhaar card, PAN card, passport, driving license, etc.
  4. Residential Proofs: Address proofs of both buyer and seller are required. The documents could include Aadhaar card, passport, ration card, electricity bill, driving license, etc.
  5. Insurance: The insurance policy needs to be transferred in the name of the buyer before or at the time of transfer of ownership.
  6. RC: Vehicle's registration certificate is to be submitted at the RTO.
  7. PUC: The Pollution Under Control Certificate needs to be updated while getting the vehicle transferred. For vehicles manufactured before 2010, the PUC certificate needs to be updated every three months.
  8. No Objection Certificate (Form 28): If the vehicle is being sold into another region or state, NOC is required.
  9. National Crime Records Bureau report: If the vehicle is involved in a criminal activity, a clearance report from the National Crime Records Bureau (NCRB) is required.
  10. Transfer fee: RTO charges a nominal fee for transferring the ownership of a vehicle.

How to Transfer Vehicle’s Ownership

Collect the above documents and visit the RTO office during the process of selling your vehicle. You will need to submit the documents along with a transfer fee of around Rs. 200 to Rs. 500 depending upon the RTO. It will take approximately 15 to 20 working days for the transfer process to complete. Transfer of ownership can also be initiated online. However, one needs to visit the RTO to complete the process.

Case Study

According to the Section 2(30) of the Motor Vehicles Act, 1988 a person who is the registered owner of a vehicle is liable to pay the compensation to the affected third-party in case of claims arising due to the vehicle. This is the law. No matter the number of evidence presented to the Motor Accidents Claims Tribunal about the sale of that vehicle, the registered owner will have to bear the consequences of any incident related to the vehicle.

A classic case of bearing the consequences of not transferring the ownership of the sold car was faced by a Delhi's resident. Two years after he sold his vehicle he was called to the police station for a case he had no hand in. One person was killed and another severely injured due to the car sold by the owner two years ago. The court did not rule in the favor of the first owner as the ownership was never transferred on record and he had to pay a compensation of Rs. 3.85 lakh just because he did not get the ownership transferred in the name of the new owner.
